Acceptance

These Terms govern your use of Buff Kitty, operated by Arta Ghasemi. By downloading, accessing, or using Buff Kitty, you agree to these Terms. If you do not agree, do not use the app.

Eligibility

You must be at least 18 years old and able to form a binding contract to use Buff Kitty.

What Buff Kitty does

Buff Kitty helps you track daily protein, set a protein target, receive local reminders, look up packaged foods by barcode, and optionally estimate protein from food descriptions or meal photos using AI.

Packaged-food product and nutrition data comes from Open Food Facts and may be inaccurate, incomplete, or out of date. Check the product label before relying on it.

Buff Kitty is not a calorie tracker, medical device, healthcare provider, dietitian, or emergency service.

Health and nutrition disclaimer

• Protein targets and AI estimates are informational estimates only.
• Buff Kitty does not provide medical, nutrition, diagnosis, treatment, or professional training advice.
• AI estimates may be inaccurate, incomplete, or inappropriate for your circumstances.
• You are responsible for reviewing and adjusting any estimate before relying on it.
• Talk to a qualified healthcare or nutrition professional before making dietary changes, especially if you have a medical condition, are pregnant, have a history of disordered eating, are a minor, or have specialized nutrition needs.

Subscriptions and payments

Buff Kitty may offer auto-renewable subscriptions, including weekly, monthly, and yearly plans, through Apple's in-app purchase system. Prices, trial terms, renewal periods, and included features are shown in the app before purchase and may vary by country, currency, taxes, and App Store settings.

Subscriptions automatically renew unless canceled before the end of the current billing period. You can manage or cancel subscriptions through your Apple account settings. Deleting the app does not cancel a subscription.

Payments, renewals, cancellations, refund eligibility, and billing disputes are handled by Apple and applicable law. Buff Kitty cannot directly process App Store refunds.

Limited license

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Buff Kitty on Apple-branded devices that you own or control, as permitted by Apple's applicable App Store terms.

Acceptable use

• Do not abuse, bypass, scrape, overload, reverse engineer, or interfere with Buff Kitty, its backend, subscriptions, rate limits, or AI features.
• Do not submit unlawful, harmful, abusive, infringing, confidential, or highly sensitive content.
• Do not submit photos containing faces, children, documents, addresses, medical records, or other identifying details to AI logging.
• Do not use Buff Kitty to make medical decisions or to provide professional advice to others.
• Do not attempt to access data, systems, keys, or accounts that are not yours.

Your content

You keep ownership of the food descriptions, meal photos, and other content you choose to provide. You grant Buff Kitty and its service providers the limited rights needed to process that content, provide the app, estimate protein, maintain security, and comply with law.

You are responsible for having the rights and permissions needed to submit any content to the app.

Third-party services

Buff Kitty depends on third-party services for App Store distribution, subscriptions, paywalls, analytics, Apple Ads attribution, backend hosting, AI processing, packaged-food product lookup, and website hosting. Those services may have their own terms and privacy practices.

You must also comply with applicable third-party terms, including Apple's App Store terms.

Apple App Store terms

If you downloaded Buff Kitty from the Apple App Store, Apple is not responsible for providing maintenance or support for Buff Kitty. Apple is not responsible for Buff Kitty's content, claims, warranties, or legal compliance except as required by applicable law. Apple and its subsidiaries may enforce these Terms as third-party beneficiaries where applicable.

Changes and availability

Buff Kitty may change, suspend, or discontinue features, pricing, subscription offerings, AI providers, limits, or availability at any time, subject to applicable law and App Store rules. We do not guarantee that the app will be uninterrupted, error-free, or available in every region.

Intellectual property

Buff Kitty, including its name, mascot, interface, software, text, graphics, and related materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Buff Kitty or its intellectual property to you.

Termination

We may suspend or terminate access to Buff Kitty if you violate these Terms, create risk, misuse subscriptions or AI features, or if we are required to do so by law or a platform provider. You may stop using Buff Kitty at any time.

Disclaimers

To the fullest extent allowed by law, Buff Kitty is provided as is and as available, without warranties of any kind, whether express, implied, or statutory. We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted operation.

Limitation of liability

To the fullest extent allowed by law, Buff Kitty and its owners, developers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, dietary decisions, health outcomes, or subscription/platform issues. Any total liability will be limited to the amount you paid for Buff Kitty in the twelve months before the claim, or $100, whichever is greater, unless applicable law requires more.

Indemnity

To the extent allowed by law, you agree to defend and indemnify Buff Kitty from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the app, your content, your violation of these Terms, or your violation of law or third-party rights.

Governing law and disputes

These Terms are governed by the laws of the State of Maryland and applicable United States federal law, excluding conflict-of-law rules. State and federal courts located in Maryland will have exclusive jurisdiction, unless applicable consumer law gives you mandatory rights in another location.

Changes to these Terms

We may update these Terms as Buff Kitty changes. If changes are material, we will provide reasonable notice. Continued use after the updated Terms take effect means you accept the updated Terms.
